TERMS AND CONDITIONS – SÓNAR KIDS
General Terms and Conditions Applicable to Sónar Kids and the Sale of Tickets

1. ACCEPTANCE OF THE TERMS AND CONDITIONS

These TERMS AND CONDITIONS – SÓNAR KIDS 2026 (hereinafter, the Terms and Conditions) apply to the Event advertised on this Website.

It is very important that you carefully read these Terms and Conditions (as well as the Specific Conditions of the Event that you will find on the Website and in the Event information available through the Authorised Sales Channel) before placing any order for or using Tickets for the Event, since, by ACQUIRING, HOLDING, USING or INTENDING TO USE any Ticket for the Event, you FULLY ACCEPT THE TERMS AND CONDITIONS AND AGREE TO BE BOUND BY THEM.

For this reason, if you do not agree with each and every one of the Terms and Conditions (or with the Specific Conditions of the Event), you must not acquire, hold, use or intend to use a Ticket for the Event.

For all matters relating to the personal data you provide as a user of our Website or during the purchase process, please consult our Privacy Policy, which you will find on the Website.

 

2. DEFINITIONS

Below are the definitions that apply to these Terms and Conditions, to facilitate a better understanding of them:

Attendee: The person who attends the Event as a customer, user or consumer, including both adults and Minors as set out in Section “4. AGE AND ACCESS OF MINORS TO THE EVENT”.

Accompanying Adult: The adult who accesses the Event accompanying one or more Minors and who assumes their care and custody throughout their stay in the Venue, whether as a parent or legal guardian, or as an adult expressly authorised by them.

Authorised Sales Channel: The sales channel or channels through which you may purchase Tickets for the Event, which are EXCLUSIVELY: (i) Online sales: Enterticket; (ii) In-person sales: ticket offices located at the Venue access points on the day of the Event itself (provided that the Event is not sold out and there is availability).

Access Conditions: The conditions for access to and stay at the Event set out in Section “5.4. RIGHT OF ADMISSION”.

Specific Conditions of the Event: The conditions and information about the Event and each of its Sessions, which are available on the Website and through the Authorised Sales Channels, and which are updated as the Event date approaches.

Organiser: FESTIVAL SÓNAR NOCHE 2016, A.I.E., with registered office at Carrer Pujades 350,  A2, and holding Tax ID No. (N.I.F.) V66783457. Contact email: sonar@sonar.es.

Ticket: The ticket, pass or season pass acquired through an Authorised Sales Channel, or provided by the Organiser, which allows access to the Event.

Event: the Sónar Kids event, whose identifying details (date, times, Venue and Organiser, among others) appear on the Website.

Minor: Any person under eighteen (18) years of age, except where legal emancipation is duly evidenced.

Ticket Types: The different categories of Tickets available to access the Event (or certain Sessions of the Event).

Wristband: The Wristband that each Attendee must obtain at the Event access lanes or at the accreditation points located throughout the city of Barcelona (by exchanging the previously acquired Ticket) in order to access the Event. In the case of purchase at the ticket office, the Wristband will be fitted at the time of purchase without the need to present a Ticket.

Venue: Parc del Fórum  Petit Anfiteatro.

Force Majeure: Any event or circumstance beyond the reasonable control of the Organiser, including, by way of example but not limitation: natural disasters, epidemics, pandemics, states of alarm, emergency or exception, governmental orders or restrictions, strikes, civil unrest, acts of terrorism, failures in essential supplies (electricity, water, communications), fires, floods, or any other analogous circumstance that prevents or substantially hinders the holding of the Event.

3. TICKET AND WRISTBAND

All Tickets and Wristbands shall be the property of the Organiser.

3.1. TICKETS

3.1.1. TICKET TYPES

There are several Ticket Types available to access the Event.

Not all Ticket Types go on sale at the same time, and therefore this information may vary depending on when you access the Authorised Sales Channel.

IMPORTANT INFORMATION: The Ticket Type not only determines which Session(s) of the Event you may access, but also establishes the additional features to which it entitles you apart from access itself (for example, fast-lane access to the Venue, access to VIP areas, inclusion of consumptions, etc.).

It is very important that you carefully read the information we provide on the Website and through the Authorised Sales Channel in order to choose the Ticket Type you wish to acquire. By purchasing a Ticket, the user declares that they have read, understood and accepted all the information relating to the Ticket Type acquired.

It is the responsibility of the user of the Authorised Sales Channels or of the purchaser of a Ticket to check the age and accompaniment restrictions and conditions, the accessibility conditions, and the other terms and conditions that apply to the purchase and/or use of the Ticket and to the Event (and which are set out in these Terms and Conditions and in the Specific Conditions of the Event).

The Organiser reserves the right to modify the prices of each Ticket Type at any time. Tickets shall be invoiced on the basis of the rate in force at the time of their acquisition through the Authorised Sales Channel. Ticket prices may vary depending on objective factors, such as the sales phase, demand, availability, proximity to the Event date or the type of Ticket. Under no circumstances shall such variations affect Tickets already acquired.

 

3.1.2. AUTHORISED SALES CHANNELS

Only Tickets acquired through the Authorised Sales Channels shall be valid (without prejudice to those provided directly by the Organiser).

IMPORTANT: The Organiser is NOT responsible for Tickets acquired through any means or channel other than the Authorised Sales Channels (including resales not carried out within the same Authorised Sales Channel).

The Authorised Sales Channels may be operated by a third party (in particular, in the case of online ticketing platforms such as Enterticket), in which case the sales process is also governed by their own terms and conditions (which may include the need to have an account on the platform or the conditions applicable to the payment systems and gateways).

In the Specific Conditions of the Event (contained on the Website or on the Authorised Sales Channel itself) you will find information on how to download and display your Ticket to access the Event.

The price of the Tickets shown on the Authorised Sales Channels is the final price, and includes all taxes and costs associated with the purchase, including, where applicable, management fees, without any hidden additional charges.

Exceptionally, if any additional cost applies to any Authorised Sales Channel or additional service, it shall be reported clearly, transparently and prior to the payment process, in accordance with the applicable consumer protection regulations.

3.1.3. RESALE AND/OR PROMOTIONAL USES

Tickets are for the strictly personal use of the purchaser and/or the authorised Attendee.

The resale, assignment, transfer or allocation of Tickets to third parties is not permitted, whether for profit or free of charge, unless the Organiser expressly authorises it in writing or specifically enables this option through one of the Authorised Sales Channels, which would be clearly indicated in the Specific Conditions of the Event.

Any Ticket that has been the subject of unauthorised resale, assignment or transfer may be cancelled, denying access to the Event or expelling its holder from the Venue, without any right to a refund or compensation.

Holding a Ticket does not confer any right to use it for advertising, promotional, commercial or marketing purposes, including competitions, prize draws, gifts or joint sale with other goods or services, except with the express written authorisation of the Organiser.

Failure to comply with the provisions of this section shall entitle the Organiser to claim for the damages caused.

3.1.4. WITHDRAWAL, CHANGES OR RETURNS

Once your Ticket has been acquired, no returns shall be accepted for any reason, except in the cases expressly provided for in Section “13. CANCELLATIONS”.

In accordance with the provisions of Article 103(l) of Royal Legislative Decree 1/2007, the purchaser of a Ticket does not have the right of withdrawal, as it is a service related to leisure activities provided for a specific date or period of performance.

In the case of a change of details and/or features of the Ticket: The modification of the Ticket holder’s details and/or of the features associated with it (where technically possible) may be subject to the payment of an additional cost, the specific amount or objective criteria for determining which shall be reported clearly and prior to confirmation of the change, with the applicant having to expressly accept said cost before the modification is carried out. The Organiser reserves the right to reject change requests depending on the proximity to the date of the Session of the Event, the Ticket Type or for duly justified operational reasons communicated to the applicant, such as technical limitations of the sales platform, exhaustion of availability of the requested type, or the closure of the management deadlines prior to the Event.

3.1.5. FRAUDULENT TICKETS

The Organiser shall be entitled to deny access to the Venue to the holder of a Ticket if any anomaly is detected in it (including duplicated and/or forged tickets). The detection of any fraudulent use of the Ticket shall be prosecuted in accordance with current legislation.

Any Ticket sold, transferred, used or assigned in breach of these Terms and Conditions (or, where applicable, the Specific Conditions of the Event) may be cancelled, and access may be denied or the person attempting to use it or using it may be expelled from the Venue (without any right to a refund or compensation).3.1.6. TICKET INCIDENTS

For any incident with your Ticket, you may contact:

  • Incidents relating to obtaining, downloading or assigning the Ticket to the end user (prior to the start of the Event): support channels indicated on the Authorised Sales Channel itself.
  • Incidents once the Event has started shall be dealt with at the point located at the Venue access points.

 

3.2.  WRISTBANDS

3.2.1. OBTAINING THE WRISTBAND AT THE EVENT ACCESS POINTS

To access the Venue of the Event you must exchange your Ticket for a Wristband at the Event access lanes or at the accreditation points located throughout the city of Barcelona. If you purchase your Ticket at the Venue ticket offices, the Wristband will be fitted to you directly.

Modified or broken Tickets, Tickets showing signs of forgery, or Tickets in which any type of anomaly is detected shall not be accepted.

 

3.2.2. FITTING, KEEPING AND USE OF THE WRISTBAND

The Wristband will NOT be handed over; instead it will be fitted to the Attendee by the access control staff. Therefore, each Attendee must obtain their Wristband personally at the access lanes or at the accreditation points located throughout the city of Barcelona, and Wristbands may not be collected on behalf of other people. In the case of Minors, the Wristband will be fitted in the presence of their Accompanying Adult.

There is a single Wristband per Ticket. Once your Ticket has been exchanged, you must keep your Wristband (fitted at the access lane) for all the days on which you are entitled to access Sessions of the Event.

Any manipulation or exchange of Wristbands is prohibited.

The Wristband is the only valid item that entitles the Attendee to access and remain at the Venue.

The Organiser is not responsible for the breakage, loss or improper manipulation of the Wristband, with the Attendee being responsible for keeping it at all times, since its loss, manipulation or breakage will make it impossible to access or remain at the Venue.

It is the Attendee’s responsibility to validate that the Wristband is perfectly closed at the time it is fitted, since a broken or manipulated Wristband shall under no circumstances be changed or replaced by another.

 

3.2.3 WRISTBAND INCIDENTS

For any incident with your Wristband, you may contact the incidents point located at the Venue access points.

 

4. AGE AND ACCESS OF MINORS TO THE EVENT

Sónar Kids is a family-oriented event designed for the enjoyment of Minors and adults. Consequently, and unlike the other events organised under the Sónar brand, Minors MAY access the Venue, under the conditions set out in this Section.

4.1. ADMISSION OF MINORS

Minors under 16 years of age may access free of charge provided that they access accompanied by an Accompanying Adult holding their corresponding Ticket, and have obtained their own zero-cost ticket. All other Minors must hold their own Ticket, in accordance with the available Ticket Types.

4.2. MANDATORY ACCOMPANIMENT

No Minor may access or remain at the Venue without the permanent company and supervision of an Accompanying Adult. Each Accompanying Adult may access with a maximum of 5 Minors in their care.

The Accompanying Adult is solely responsible for the care, custody, safety and supervision of the Minor throughout their stay at the Venue and at the access points to it. The Organiser does not under any circumstances assume any function of care, custody or supervision of the Minors.

The Organiser reserves the right to deny access to, or to require the departure from the Venue of, any Minor who is without the supervision of an Accompanying Adult, as well as to adopt the measures to protect the Minor that are appropriate in accordance with current regulations.

4.3. AUTHORISATION FOR MINORS NOT ACCOMPANIED BY THEIR PARENTS OR GUARDIANS

Where the Accompanying Adult is neither a parent nor a legal guardian of the Minor, they must carry and present, at the Organiser’s request, an authorisation signed by whoever holds parental authority or guardianship over the Minor, in accordance with the model provided by the Organiser, together with a copy of the signatory’s identity document. Failure to present said authorisation may result in the denial of the Minor’s access, without any right to a refund.

 

5. ACCESS TO THE VENUE AND RIGHT OF ADMISSION

5.1. NEED FOR A FITTED WRISTBAND IN GOOD CONDITION

To access the Venue you must have the Wristband properly fitted on your wrist. Access to (or remaining at) the Venue shall not be permitted without a Wristband, or with Wristbands that are visibly manipulated, damaged or broken. If your Wristband is valid for several Sessions of the Event, you must keep it for all the days in order to access each of the Sessions of the Event to which it gives access.

5.2. ITEMS NOT PERMITTED IN THE VENUE

The Organiser may restrict the entry into the Venue of any item that may be dangerous, unsafe, unhealthy or whose use may contravene these Terms and Conditions and, where applicable, the Specific Conditions of the Event.

In accordance with current legislation, Attendees (and the bags, handbags, backpacks or similar with which they wish to enter the Venue) may be searched by the Event security staff in order to prevent the entry of these items.

An Indicative List of Items Not Permitted in the Venue is included below:
  1. Aerosols or other containers of/with gas.
  2. Weapons, or objects that could produce the same effects, such as sharp, cutting or pointed elements, or those deemed dangerous to safety (including selfie sticks).
  3. Flags, banners, posters or other propaganda elements containing (i) political propaganda, or (ii) religious propaganda, or (iii) discriminatory messages, whether on grounds of race, gender, age, nationality, culture, religion, sexual orientation, or any other –whether or not it may be deemed exclusionary–, or (iv) defamatory, slanderous or aggressive messages, hate speech, or messages tending to disturb public order; or (v) any other type of message or propaganda deemed inappropriate for a festival or live music event. THE EVENT IS NOT ASSOCIATED WITH ANY POLITICAL, IDEOLOGICAL OR RELIGIOUS SYMBOL.
  4. Bags, handbags, backpacks or similar whose dimensions exceed 40x20x25cm or with a capacity greater than 20L.
  5. Motorcycle, bicycle, scooter or similar helmets.
  6. Cascos de moto, bicicleta, patinetes o similares.
  7. Drinks (except water in bottles of a maximum of 500ml and without a cap). The entry of drink containers (such as flasks or hip flasks) is also not permitted.
  8. Drones.
  9. Drugs, other illegal substances or other consumer substances deemed unsafe, including new psychoactive substances (commonly known as “legal highs”) and/or nitrous oxide also known as laughing gas, and/or any utensil for the production of such substances.
  10. Items that may interfere with the Event’s shows and activities or disturb other Attendees, such as: (i) megaphones, vuvuzelas, horns or other similar objects capable of making a loud noise; (ii) laser pointers or torches; (iii) firecrackers, flares, fireworks or other pyrotechnic articles; (iv) portable communication devices such as walkie-talkies, jammers, radio scanners or similar; (v) high-vis clothing; (vi) helium balloons or other elements positioned above the general public that hinder the visibility of the shows and performances.
  11. Furniture items such as parasols, sunshades, chairs (folding or not), tables (folding or not), barbecues, or tents.
  12. Glass objects.
  13. Vehicles (of any kind), including bicycles, motorcycles, skateboards, scooters or personal motorised vehicles. Persons with reduced mobility, or other special needs, may contact the Organiser through the form; for more information you may consult the Accessibility section of the website.

The Organiser is not responsible for any prohibited item or other articles deemed inappropriate or unsafe that are confiscated to allow entry to or stay in the Venue of the Event.

In the event that the security staff detect the presence of any of these items not permitted in the Venue, the Attendee will be accompanied to leave the Venue in order to remove the non-permitted item.

On an indicative (non-limiting) basis, the following items WILL be permitted:

  1. Small bags, bum bags, backpacks or handbags (dimensions equal to or smaller than 40x20x25cm and a maximum capacity of 20L).
  2. Water bottles of up to 500ml (without a cap).
  3. The food, liquids and utensils necessary for feeding Minors (baby bottles, baby food jars, purées and similar), in reasonable quantities and for personal use.
  4. Caps, sunglasses, fans and sun creams (containers no larger than 50ml, and which are not aerosols).
  5. Tobacco / electronic cigarettes. Their use shall only be permitted in outdoor spaces.
  6. Vehicles necessary for the accessibility of persons with reduced mobility or other special needs (provided that, prior to the Event, the Attendee has arranged the necessary permits with the Organiser to access with the vehicle).
  7. Pushchairs, strollers and baby carriers, in accordance with the instructions of the Event staff and the Specific Conditions of the Event.

 

5.3. SECURITY CHECKS AND MEASURES

For reasons of safety, risk prevention and in compliance with current regulations, the Organiser informs that the accredited security staff may carry out superficial searches (pat-downs) of Attendees, as well as the inspection of bags, backpacks or personal belongings, at the access to the Venue or during the stay therein. Searches of Minors shall be carried out in the presence of their Accompanying Adult.

Said searches shall be carried out in a proportionate and respectful manner and in accordance with the law, and have the sole purpose of guaranteeing the safety of the Attendees, artists, workers and the Event itself.

Refusal to undergo these security measures may result in the denial of access to the Venue or expulsion from it, without any right to a refund or compensation.

5.4. ACTIVITIES/CONDUCT NOT PERMITTED AT THE EVENT

Any type of activity or conduct that the Organiser considers may be dangerous, unsafe or unhealthy, or that may contravene these Terms and Conditions and, where applicable, the Specific Conditions of the Event, is prohibited.

An Indicative List of Activities and/or Conduct not permitted at the Event is included below:
  1. Aggressive or violent behaviour, behaviour causing altercations or disturbances, or that publicly incites hatred, violence or discrimination on grounds of birth, race, sex, religion, opinion, disability, sexual orientation, gender identity, or any other social or personal condition or circumstance, which endangers public order or hinders the normal development of the Event (or of any activity or show within it). THE ORGANISER IS COMMITTED TO THE WELLBEING OF ALL ITS ATTENDEES.
  2. Activities that are annoying to other Attendees, unhealthy, harmful, dangerous or unlawful, or that may constitute a criminal offence.
  3. Climbing on, or remaining on: fences, barriers, trees, bushes, walls, security elements (including stone or concrete separators), attractions, temporary structures, exhibitions, buildings or other elements or structures of the Event that are clearly not intended for Attendees to climb on or remain on.
  4. Carrying elements that may be annoying to other attendees or totally or partially impede a good view of any artistic performance.
  5. Entering (or attempting to enter) restricted areas, areas where the general public is not permitted, or areas to which the Ticket Type acquired does not allow access.
  6. Crowd surfing and moshing, or other similar activities deemed unsafe for the general public.
  7. Activities tending to cause (or that may cause) fires, taking part in them, or throwing objects with/at the fire.
  8. Smoking in enclosed spaces or other spaces where smoking is not permitted.
  9. Carrying out activities whose purpose is political or religious propaganda. THE EVENT IS NOT ASSOCIATED WITH ANY POLITICAL, IDEOLOGICAL OR RELIGIOUS SYMBOL.
  10. Carrying out activities whose purpose is (i) the promotion of any good or service, or (ii) the recruitment of customers, members or affiliates (to any type of organisation or entity, whether for profit or not); all of this except in the cases expressly authorised by the Organiser within the framework of the organisation and operation of the Event.
  11. Carrying out street vending or any other type of commercial activity (except those expressly contracted/authorised by the Organiser within the framework of the organisation and operation of the Event). In the event of an infringement, the Organiser shall be entitled to claim from the infringer the damages actually caused, including loss of profit, as well as to exercise any legal actions that may correspond in accordance with current legislation.
  12. The consumption of alcohol and tobacco by Minors.
  13. The acquisition by an adult of any type of alcoholic beverage for a Minor.
  14. Audiovisual recording of any of the performances and shows of the Event for commercial or promotional distribution in any medium, without being a medium authorised by the Organiser.
  15. Attempting to pay by any means other than the payment methods permitted at the Event (as set out in Section “9. PAYMENT METHODS PERMITTED WITHIN THE VENUE” and, where applicable, in the Specific Conditions of the Event).

5.5. RIGHT OF ADMISSION

The Organiser reserves the right of admission, which shall be exercised in an objective, proportionate and non-discriminatory manner, in accordance with the provisions of the regulations in force regarding public events and recreational activities of Catalonia. The admission conditions shall be communicated visibly to the public.

Admission to and stay in the Venue of the Event is conditional upon compliance with the following Access Conditions:

  1. Compliance with the age and accompaniment requirements established in Section “4. AGE AND ACCESS OF MINORS TO THE EVENT”.
  2. Holding and keeping the Wristband under the terms of Section “5.1. NEED FOR A FITTED WRISTBAND IN GOOD CONDITION”.
  3. Not having or introducing into the Venue any of the items detailed in the Indicative List of Items Not Permitted of Section “5.2. ITEMS NOT PERMITTED IN THE VENUE”.
  4. Not carrying out any of the activities/conduct detailed in Section “5.3. ACTIVITIES/CONDUCT NOT PERMITTED AT THE EVENT”.
  5. Complying with the remaining rights and obligations included in these Terms and Conditions and, where applicable, in the Specific Conditions of the Event, which are established to guarantee both the proper enjoyment of the Event by all Attendees and the safety of all staff and artists working at the Event.

In particular, the Organiser reserves the right to deny access to or stay in the Venue to Attendees who:

  1. Contravene the objective instructions of the Organiser (and in particular of the Event security staff) applicable generally to all the public and aimed at guaranteeing the proper development and operation of the Event, and the safety and wellbeing of the Attendees, as well as of the artists and workers thereof.
  2. Engage in behaviour or conduct not permitted (as described in Section 5.3 above). In particular, the Organiser reserves the right to deny access to the Venue to any person who engages in aggressive or violent behaviour, behaviour causing altercations or disturbances, or that publicly incites hatred, violence or discrimination, at the entrance or surroundings of the Venue (without the need for such conduct to have taken place inside the Venue).
  3. Attempt to introduce, introduce, carry or use any kind of weapons or objects that could produce the same effects, such as sharp, cutting or pointed elements, or those deemed dangerous to safety; or any illegal substance. This is without prejudice to the power to deny access to any Attendee attempting to introduce the items detailed in the Indicative List of Items Not Permitted of Section 5.2.
  4. Show signs of intoxication or are consuming drugs or narcotic substances or show signs of having consumed them. Are in possession of or traffic in drugs or other narcotics.
  5. Do not meet the conditions and/or requirements established on grounds of age or accompaniment.

Non-admission to or expulsion from the Venue, based on the provisions of this Section, shall not entail the return or refund of the Ticket price. It may also entail the immediate removal of the Wristband (which shall remain in the possession of the Organiser without the possibility of being reused).

 

5.6. CLOSING OF VENUE ACCESS

The Venue access doors shall close one (1) hour before the end of the programming of each day. Consequently, access to the Event shall not be permitted after 19:00. Once access has been closed, the Attendee shall not be able to access the Venue, regardless of whether they hold a valid Ticket or pass, without any right to a refund or compensation.

 

6. CAPACITY

The Venue, and within it its different areas, have a limited capacity that shall be controlled by the Event staff, so that once that limit is reached, access shall be cut off. People may only access the Venue when the capacity is not full. Likewise, Attendees with a Ticket Type that allows access to a specific area within the Venue may only access that area when its capacity is not full. Consequently, the Organiser shall under no circumstances be responsible for the impossibility of certain Attendees accessing the Venue, or a specific area within it, at a given time, if these are at full capacity.

 

7. ACCESS OF ANIMALS TO THE VENUE

As a general rule, access to the Venue with animals is not permitted. Persons with special needs may contact the Organiser through the contact form they will find on the Website, or via the email address sonar@sonar.es.

 

8. PAYMENT METHODS PERMITTED WITHIN THE VENUE

Unless otherwise indicated in the Specific Conditions of the Event, the only payment systems permitted within the Venue are card and cash.

PAYMENT FOR ANY PRODUCT OR SERVICE WITHIN THE VENUE THROUGH A DIFFERENT PAYMENT METHOD (INCLUDING BIZUM OR ANY TYPE OF EXCHANGE) IS NOT PERMITTED.

The control and security staff may expel from the Venue any Attendee who makes or attempts to make payment for a good or service within the Venue in breach of this provision.

 

9. FOOD AND BEVERAGE SALES POINTS

In order to guarantee the safety, hygiene and healthiness of the Attendees (including food safety), the entry of drinks into the Venue of the Event is not permitted (except for water in plastic bottles of a maximum of 500ml without a cap). Given the family-oriented nature of the Event, access shall additionally be permitted with the food, liquids and utensils necessary for feeding Minors (baby bottles, baby food jars, purées and similar), in reasonable quantities and for personal use.

The Venue shall have (i) free drinking water points; (ii) sales points for both drinks and food.

Reusable cups policy: As part of our commitment to sustainability and the environment, a reusable cups policy has been implemented. In this regard, unless otherwise provided or specifically regulated in the Specific Conditions of the Event, the Event shall have reusable cups, which shall be made available to Attendees for a deposit. In order to purchase drinks within the Event, Attendees must necessarily have one of these reusable cups.

The system shall operate as follows:

  1. Upon purchasing a drink, the Attendee shall pay the deposit corresponding to the reusable cup and shall receive, together with their drink, one (1) token evidencing the payment of said deposit, which shall remain valid throughout the Event.

  2. The Attendee may request the exchange of their cup for a clean one upon purchasing new drinks, handing in the used cup at the bar and receiving in exchange a clean cup together with the drink requested.

  3. The used cups collected at the bars shall be removed for cleaning, sanitisation and reuse at future editions of the Event, in accordance with the sustainability policy described.

  4. At the end of the Event, the Attendee may return the reusable cup together with the token, at which point the deposit amount shall be refunded to the person who makes the return.

The loss, deterioration or non-presentation of the token and/or the reusable cup at the time of return shall result in the loss of the right to a refund of the deposit.

 

10. TRANSPORT AND PARKING

Travel to reach the Event, as well as the parking of vehicles, are at the expense and risk of the Ticket holder. As part of our commitment to the planet and the environment, we advise and urge the use of public transport.

 

11. CHANGES TO THE SPECIFIC CONDITIONS OF THE EVENT

The Event is made up of a variety of artists, activities and performances.

The Organiser shall endeavour to maintain the line-up and timetables of the Event and of the proposed artists. However, all of these may undergo variations due to the Event’s own needs or for reasons beyond the Organiser’s control.

The Organiser reserves the right to modify the programming, which it shall communicate to the Attendees as far in advance as possible through the Website, social media and, where possible, by individual communication.

Such changes shall under no circumstances give rise to the right to obtain a return or refund of the price of the Ticket acquired.

 

12. CANCELLATIONS

For the purposes of these Terms and Conditions, force majeure causes shall be deemed to include, among others, weather warnings, orders, recommendations or restrictions imposed by public authorities, risks to the safety of persons or property, as well as any circumstance beyond the reasonable control of the Organiser that makes the holding of the Event or its continuity inadvisable.

Total Cancellation of a Session of the Event

In the event of total cancellation of a Session of the Event, the following shall apply:

 

  • (i) The Organiser shall notify the purchasers of the Tickets as soon as possible, with the purchasers being responsible for finding out whether the Event has been postponed, rescheduled or cancelled, and, where applicable, about the new dates or Venue at which it will take place.

  • (ii) Attendees shall be refunded the price of the Ticket corresponding to the Session of the Event that has been cancelled in its entirety. This refund shall be partial in the case of Tickets that additionally give access to Sessions of the Event that have not been cancelled, and it shall be the Organiser who determines the part of the Ticket price corresponding to the cancelled Session of the Event, based on objective criteria.

  • (iii) In the case of rescheduling, the Organiser may offer the purchaser the option of keeping the Ticket for the rescheduled Session of the Event. Likewise, the purchaser may be offered the possibility of exchanging it for another (or other) events organised by the Organiser or its group.

  • (iv) IT SHALL BE THE RESPONSIBILITY OF THE TICKET PURCHASER TO REQUEST THE REFUND, in the time and manner indicated by the Organiser, and to provide all the information that the Organiser requires for this.

    Partial cancellations

In the event that it is necessary to suspend or partially cancel a Session of the Event due to (i) fortuitous causes, (ii) force majeure causes and/or (iii) causes of any other nature that, being beyond the Organiser’s control, recommend the cancellation (such as reasons of safety, weather warning, prudence and/or risk to third parties), no refund shall be available. The above applies to: (i) If, once the Session of the Event has started, it is halted or not completed; (ii) If the start time of any Session of the Event is delayed.

Bad weather conditions and changes of timetables within each of the Sessions of the Event also do not give rise to a return or refund (whether total or partial) of the Ticket amount.
 

13. COVID-19 AND OTHER TRANSMISSIBLE VIRUSES OR DISEASES

The purchaser of a Ticket acknowledges the risks (known and potential) of the virus known as COVID-19, or other easily transmissible viruses or diseases, and understands that: (a) such risks increase with proximity to other people; (b) such risks cannot be completely eliminated within the framework of the Event; (c) there is an inherent and elevated risk of exposure to COVID-19 (or other easily transmissible viruses or diseases) in any public place or place where people are present; and (d) there is no guarantee (express or implied) that they will not be exposed to COVID-19 (or other transmissible viruses or diseases) if they access the Venue of the Event.

The Organiser reserves the right (at its sole discretion) to put in place, modify or eliminate measures related to the COVID-19 virus and other easily transmissible viruses or diseases, at any time (before or during the holding of the Event), and in particular in response to the latest guidelines, recommendations or legislation of the competent authorities.

The Organiser reserves the right not to permit access to (or to expel from) the Venue any person who refuses to comply with the measures applicable to the Event related to the COVID-19 virus or other easily transmissible viruses or diseases.

 

14. RECORDINGS DURING THE EVENT

BY ATTENDEES

Attendees acknowledge and accept that the Organiser holds and owns all intellectual property, industrial property and any other rights, including image rights, derived directly or indirectly from the performances (artistic or of any other kind) that take place on the occasion of the holding of the Event, without territorial or time limitation, and without any limitation other than those provided for in the Intellectual Property Act in force.

The capture, fixation or recording of images or sounds for commercial purposes of any kind is strictly prohibited.

The Organiser may expel any person who fails to comply with the foregoing obligation, without this giving rise to any right to a refund of the Ticket amount.

BY THE ORGANISER (OR OTHER EVENT COLLABORATORS)

At the Venue there may be staff with cameras (both photo and video) and other professional systems for recording images and sound, as well as the presence of the media. All these professionals are authorised to make recordings (visual, audio or audiovisual), which may be published or disseminated publicly (by the Organiser or by third parties), through any medium, including television, social media, websites, etc.

Upon accessing the Event, adults accept being photographed, filmed or included in a sound recording. To this effect, Attendees of legal age expressly and free of charge authorise the capture and fixation of their image and/or voice during the holding of the Event, and its subsequent dissemination by the Organiser or third parties authorised by it through any medium, for promotional purposes linked to the Event and to the Organiser’s activity, for a maximum period of five (5) years from the date of capture. The Attendee may revoke the consent given at any time by contacting the Organiser via the email address sonar@sonar.es, without such revocation affecting the lawfulness of the processing based on the consent prior to its withdrawal.

Minors. In the case of Minors, the capture and dissemination of their image and/or voice for promotional or commercial purposes shall require the express consent of those who hold parental authority or guardianship over them, granted through the authorisation model provided by the Organiser. Unless such consent has been specifically obtained, the presence of a Minor at the Venue does not imply any authorisation for such use. Notwithstanding the foregoing, the Accompanying Adult and the Minor’s guardians acknowledge and accept that, at mass events, general or ambience images may be captured in which the Minor appears incidentally and not individually. Consent may be revoked at any time by contacting the Organiser via the email address sonar@sonar.es.

 

15. DATA PROTECTION

The personal data provided at the time of acquiring a Ticket or as a user of the Website shall be processed by the Organiser, as data controller, in accordance with Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights (LOPDGDD), and the Privacy Policy available on the Website. The purposes and legal bases of the processing are as follows: (i) the management of the contractual relationship arising from the acquisition of Tickets, including invoicing and handling of incidents (legal basis: performance of the contract, Art. 6(1)(b) GDPR); (ii) compliance with the applicable legal obligations, including tax and accounting obligations (legal basis: legal obligation, Art. 6(1)(c) GDPR); and (iii) the sending of electronic commercial communications about services, products and promotions of the Organiser (legal basis: consent of the data subject, Art. 6(1)(a) GDPR, which may be revoked at any time). Personal data shall be kept for the time necessary to fulfil the indicated purposes and, in any case, during the applicable legal limitation periods.

Minors’ data. The processing of Minors’ personal data shall be carried out in accordance with Article 7 of the LOPDGDD. Where, within the framework of the Event, it is necessary to process data of Minors under fourteen
(14) years of age (for example, for the management of access authorisations, children’s activities or image rights), such processing shall be based on the consent of those who hold parental authority or guardianship. The person who provides a Minor’s data warrants that they are entitled to do so.
 

You may exercise your rights of access, rectification, erasure, restriction of processing, data portability and objection, as well as the right not to be subject to automated individual decisions, by contacting the Organiser via the email address: sonar@sonar.es. We also inform you of your right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es) if you consider that the processing of your personal data does not comply with current regulations.

When you use the online ticket sales platforms, you must also read and accept their privacy policy.

 

16. LIABILITY OF THE ORGANISER AND LIMITATIONS

Attendance at and access to the Event is at the expense and risk of the Attendee, with the Organiser not being in any case liable (except for legal breach, wilful misconduct or gross negligence) for the losses, injuries or damages (whether direct or indirect) that may be suffered within the framework of the Event (inside or outside the Venue). The Attendee is responsible for their own behaviour during the Event and for the risks inherent in attending a mass event, undertaking to act responsibly and in accordance with the safety and coexistence rules.

In the case of Minors, it is the sole responsibility of the Accompanying Adult (and, where applicable, of those who hold parental authority or guardianship) to decide on the Minor’s attendance at the Event, as well as to ensure at all times their care, custody, safety and supervision, in accordance with Section “4. AGE AND ACCESS OF MINORS TO THE EVENT”.

Without prejudice to the provisions of the preceding paragraphs, the Organiser’s liability shall be determined in accordance with current regulations, being liable for the damages actually caused and duly evidenced. The Organiser shall not be liable for any other expense associated with attendance at the Event (such as travel, accommodation or per diem expenses), nor for the value of the objects that may be damaged, lost or stolen during the Event, unless such damages are directly attributable to the wilful misconduct or gross negligence of the Organiser.

If access to the Venue is denied (or there is expulsion from it) to an Attendee or holder of a Ticket for any of the reasons established in these Terms and Conditions or in the Specific Conditions of the Event, the Ticket (or Wristband, as appropriate) acquired shall cease to be valid, without any right to a refund or return of any amount arising.

 

17. WARNINGS AND RECOMMENDATIONS

By purchasing a Ticket and/or attending the Event, you know and accept that:

  1. The performances that take place within the framework of the Event may use strobe lights, laser lighting, pyrotechnics and/or smoke machines, which may be annoying to you.

  2. The stages have loudspeakers that are used during the performances of the various artists. Loud music can damage hearing; the use of appropriate hearing protection for Minors is especially recommended.

  3. The Organiser endeavours to ensure that the Venue is equipped with the structures and measures necessary to provide a safe environment. However, Attendees must be careful when moving around inside the Venue.

  4. –    The Venue may have video surveillance cameras for reasons of safety of persons and property and crime prevention, in accordance with the provisions of Article 22 of Organic Law 3/2018 (LOPDGDD) and Article 6(1)(c) and (f) of Regulation (EU) 2016/679 (GDPR). The controller of the captured images is the Organiser. The recordings shall be kept for a maximum period of one (1) month from their capture, unless they must be made available to the competent authorities in the event of an incident. Attendees may exercise their rights of access, erasure and other rights recognised in current regulations by contacting the Organiser via the email address sonar@sonar.es.

In the event of an emergency, the Attendee must follow the instructions of the Organiser and, in particular, of the Venue security staff.

 

18. ATTENDEE SUPPORT AND COMPLAINTS

At the Venue you will find the information and incident management point clearly identified.

To make any complaint, it shall be necessary for the Attendee to identify themselves and prove their status as an attendee of the Event.

19. PPREVALENCE AND MODIFICATIONS
 

The Organiser may modify these Terms and Conditions if it deems it necessary, for the following objective causes: (i) legislative or regulatory changes affecting the organisation of the Event; (ii) judicial or administrative decisions requiring the conditions to be adapted; (iii) reasons of safety, public health or duly evidenced force majeure; or (iv) operational modifications arising from changes in the Venue, in the essential suppliers of the Event or in the Authorised Sales Channels.

20. LEGAL RESERVATION

The Organiser is entitled to take such legal measures, both civil and criminal, as it deems appropriate against those responsible for any attempted fraud, trespass and/or for damages caused to the Organiser, directly or indirectly.

 

21. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions have been drafted and shall be read and interpreted in accordance with the Spanish legislation applicable to the place where the Event is held.

For the resolution of any type of conflict between the Organiser and the user, the courts and tribunals of the city of Barcelona shall have jurisdiction, without prejudice to the rights of the consumer, who may bring a claim before the courts of their place of residence.
